1. Agreement to Terms
By purchasing a design or development service from withdave.studio, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use our services.
2. Services Provided
withdave.studio, operated by davekdesigns we offer project-based design and development services including:
Branding, Web Design, Illustration, General Design, Framer Development, as it pertains to websites.
2 rounds of revisions are included, but our check-point updates throughout your project timeline ensure a smooth process.
Payment
Price
$2,500 for a template and for custom site quotes vary.
Billing
Charged 50% upfront and 50% after site is approved before hand-off
Payment Method
Processed securely via hellobonsai or other agreed method
Refund Policy
Refunds are only offered in the event that you are genuinely unsatisfied with withdave.studio services and no reasonable resolution can be reached.
If a refund is approved, it will be prorated, deducting the cost of days already worked within the project timeline.
4. Intellectual Property
- Upon final payment, you own the rights to all final design and development deliverables.
- withdave.studio retains the right to showcase work for marketing or portfolio purposes with your prior approval.
- Source files and project assets are provided upon request.
5. Turnaround Time & Communication
- Most template builds take less than a working week, depending on specifics.
- Larger or more complex custom site designs + development may take up to 3 weeks.
- Communication is handled asynchronously via agreed channels (e.g. email, Loom).
6. Limitation of Liability
To the fullest extent permitted by law:
- withdave.studio's liability for any claim is limited to the amount you paid in accordance to your project.
- We are not liable for indirect, incidental, special, or consequential damages.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
8. Privacy Policy Incorporation
By using our services, you also agree to our Privacy Policy (below), which explains how we handle your personal information.
9. Changes to Terms
We may update these Terms from time to time. Updates will be posted on our website, and continued use of our services means you accept the changes.
